Terms of service

1. Agreement

These terms form a binding agreement between AA Allround Services, trading as DushiCharge and ChargAway ("DushiCharge", "we"), and the renter ("you").

By using our powerbank rental service on Curaçao you agree to these terms.

DushiCharge may amend these terms. The latest version is published at dushicharge.com/voorwaarden. Continued use constitutes acceptance of the latest version.

2. Rental process

• All powerbanks and stations remain property of DushiCharge; you receive temporary use only.
• Rates, deposit and daily cap are displayed on the station screen before rental. The rate at your exact location always applies.
• Prices may vary by location. You must use a valid payment method.

3. Use and care

• Use the powerbank safely and according to instructions on the station.
• You are responsible for damage, loss, theft or misuse from issue until correct return.
• Prohibited: opening, dismantling, vandalism, removing stickers, sabotage or commercial use without written consent.
• Inspect before use. If damaged or defective: report immediately; do not use.
• You have a 2-minute inspection period to exchange free of charge if defective.
• Charge level and charging speed are not guaranteed.
• DushiCharge is not liable for damage to your phone from incorrect use or incompatible cables.

4. Rates and rental period (Curaçao — USD)

Standard rates at DushiCharge stations on Curaçao:

• First 2 minutes free (inspection period)
• $3.00 per 30 minutes (standard)
• $10.00 deposit (refunded on correct return; rental fees deducted)
• $10.00 daily cap (you never pay more per day)
• Location-specific rates may differ; the station screen always applies

5. Payment and disputes

• You agree to all rental fees, deposit, location rates and any damage or replacement costs.
• You authorise DushiCharge to charge automatically via Stripe.
• You have 14 calendar days to dispute charges via hello@dushicharge.com, with date, transaction, location and reason.
• Additional charges may apply in cases of fraud, abuse or intentional damage.

6. Liability

• DushiCharge is not liable for damage, injury or loss from use of the powerbank, malfunctions, empty battery, network issues or force majeure.
• Liability is limited to intent or gross negligence.
• You indemnify DushiCharge against third-party claims arising from incorrect or unlawful use.

7. Privacy

We process personal data in accordance with the GDPR and LBp. The full Privacy Policy is at dushicharge.com/privacy.

8. Force majeure

DushiCharge is not liable for failure caused by circumstances beyond our control, such as power outages, payment provider failures, internet outages, fire, vandalism, theft or extreme weather on Curaçao.

9. Right of withdrawal

The service is delivered immediately upon issue of the powerbank. The statutory 14-day cooling-off period does not apply to rental already provided.

10. Termination

DushiCharge may suspend or terminate service in cases of fraud, breach of these terms, abuse or unpaid amounts.

11. Applicable law

For rentals on Curaçao, the laws of Curaçao apply to the extent permitted by mandatory law. Disputes are submitted to the competent court in Curaçao.

For consumers from the EU/EEA, mandatory consumer protection rules apply where required by law.
